my sons partner has left, and wants her mane of the mortgage to enable her to get a council property.
my son was made redundant in december, he has his daughter thursday to sunday, and wednesday to friday, alternate weeks.
and his son fri to sun. he wants to stay in the property as he has no where to go or for his children to spend time with him, he has received a letter from her solicitor to say they are going to force the sale of the house, can he stay and have her name taken off.

As the property is in her name it is unlikely that this can be removed unless she agress to this or sells the property 1st.

all she wants is her name off the mortgage, will the building society accept this and let him continue on his own, at the moment as he is redundant they are only paying the interest.

Hi,

I am going through similar at the moment. My B/S Abbey will not remove my name even tho I am divorced and my ex wife lived there with another man and my 2 children under 16. The option is my ex buys me out, which she says she cant raise a mortgage as she is on benefits, and guy lives with her 3 days aweek, which is allowed when you on benefits. I cannot force a sale because children under 16 living there. I am due to remarry and cannot buy a home of my home with my new partner as I am linked to that mortgage, although I do not pay that mortgage, just child maintenance via CSA. If she remains unmarried and living with men and never gets a full time job, building society told me I am linked to that mortgage til last penny is paid in 20 years. The law should be reviewed on this issue.
