Shariah law & divorce

Postby Sophy » Thu May 28, 2009 12:12 pm

I want to petition for a divorce, I have been married for 5 months. My marriage broke down in January and I have been forced into seperation. I have taken advice from the islamic shariah council, who have advised mediation. My husband was very abusive and never around.
Shariah council has advised him that what he is doing is wrong but he just doesn't seem to be listening. I needs advice and wants to know my rights for a divorce in both civil and shariah law.

Divorce proceedings cannot be commenced until you have been married for at least 1 year.
At the moment there is nothing you can do and you will needs to wait for the the anniversary of your marriage and then contact a solicitor at that point. If however, you are unemployed then you may be entitled to legal aid and should contact a legal aid lawyer.
