Rain damage to house caused by a neighbour's build

Postby katea » Wed Jun 24, 2009 4:56 pm

Hi, can you please advise re ingress of severe water damage to my property, caused by a roofer replacing the roofs on my two neighbours properties. The falling rubble landed in my guttering, which was not able to cope with the heavy rains that we had a few weeks ago. Subsequently the rain penetrated my roof, loft and now the lathe and plaster ceiling needs to come down. The room needs redecorating and the furnishings need replacing. I contacted the roofer and he refuses to acknowledge that his men did this, even though I have two bags of rubble to prove to him. What are my option? - Kate :(

I would certianly reccomend getting a report from another contractor to try and prove that the issue you have mentioned is infact due to the builder on your neighbours property. You may have to pay for this initially. Once you have some strong evidence to suggest that the damage was caused by the neighbours you should consider taking action against the builder whom caused the damage. A good civil and commercial litigation solicitor would certianly help you out. The contractor will more than likley have insurance which you could claim from. I would also suggest writing to the builder alerting him of the events in teh 1st instance.
