Fined for driving with a mobile phone! innocent!!

Postby Jamieclair » Thu Jul 09, 2009 12:56 pm

My partner is a multi-drop driver, he has been for years, I have personally bought him two hands free kits, one is a speaker that is attached to his viser for his work phone, the other is head phones that are connected to his personal phone.
He was on his way to Anglesey on a dual carrage way doing approx 50mph the officer who stopped him half an hour later was doing approximately the same speed going in the opposite direction.
The officer who asked my partner to get out of the van saw him unplug his hands free kits as he got out to get into the police car. The second officer who was taking his details was told about this but the officer who saw him unplug them said nothing.
We have pleaded not guilty and have a court date set for next month, my partner is now worried that it will cost us more to go to court and that a judge will not believe a word he says over the two officers, I am so annoyed that I want to take this further as I know full well my partner always uses his hands free kits!
Any advice on what to do and how to deal with this would be a great help. He cannot afford to have 3points on his license and I certainly dont want him to plead guilty to something he hasnt done! Thanks for your time

HI,

It would appear that you are very certain about the whole issues. Pleading not guilty would probably be the best bet if you are 100% certian that you were not using a mobile when driving the vehicle. It really comes down to the officers statment against your statement and what the judge decides on the day. I would certainly mention the issue regarding 2 handsets and also the fact that you have been driving for years and that 3 points for an offence that you have not commited is absurd.
