Can I get my horse back????

Sorry if this is in the wrong area.... Couldnt find the right place....

I rehomed a horse on 29th March 2009 with the following agreement
Terms and Condition of Rehoming "N"
N is to be rehomed and is not allowed to be sold on, Loaned out or given away to anyone else. If in the sad event that N is to be put down Miss A is to be contacted as soon as possible. N is microchipped and can be traced through that I.D. N is due to foal in May and this foal is a gift to do with as you wish. If at any point she or the foal are no longer wanted both can be returned to Miss A. N passport will be kept by Miss A for a period of 6 months and if she is happy with the passport then will be handed over. The covering certificate and Vaccination Certificate will travel with N.

This was signed by both of us Only a week later I have been hastled by them insisting I had over the passport ...I requested to go over and see how my mare is then will hand it over but this was refused telling me to put it in the post. I have now asked many times to come and see her and have been refused...They have been abusive and I have written insisting to be told where she is and this has been ignored. I have now found out where she is ,on a stud yard. Am I legally allowed to go and collect her. She has now foaled.???

You may be convited of trespassing, and theft if you attempt to reclaim your foal. Although you have written to them I think waiting a while for a reponse before taking further action would be a good idea. You could contact a solicitor specialising in civil & commercial litigation to write to them on your behalf but this could be costly.
