I'm a young fashion designer. In May I entered a major UK fashion design competition in which I sent in 20 A4 hand painted designs. To cut a long story short. I didn't get through, but I am trying to get my original drawings back from the organisers. At first they said they might be able to organise a day for people to collect their work. However, they are now insisting that they cannot give me them back but can send me colour photocopies- they want to keep the originals for their archives. They are saying that these are the terms and conditions of the competition. They have also said that I'm not the only person asking for them back.

I would really like some legal advice about this?

I have a registered company, but I am just starting out in business. I would have thought competitions that promote 'supporting young designers' would be helpful? This one is not. One of the official sponsors is the Major of London.
The problem is, I really need the drawings back. I am currently making the collection and need some of the information (fabric swatches) on the design sheets. I know now that I should not have sent in the originals, but this was done in good faith, to enhance my chances of getting through.

I've tried begging, to no avail. What can I do now? If anyone can help I would be so very grateful?

Hi,

It seems that you have been put in an unfortunate position in regards to the competition. You should ask them for a copy of the competiiton agreement that you entered into. If it states clearly that you will not get the originals back then you will more than likly have to see it as a loss. You should also raise question whether or not you were informed at the time of signing the agreement as to whether or not you would get the originals back.

Thanks for the reply.

Since writing this they have agreed to give them back to me in March 2010, when they say the competition is closed. They have already selected their winners, so it doesn't make much sense? I'm not sure why they want to hold onto my work for so long? It's hardly promoting support to a young designer! I'm hoping when I approach them in March they keep to their word.
