Visa Appeal

Hello,

I recently applied for the Tier 1 extension and used an adviser to do so due to the complicated process. I was charged a fee by the advisor for their services of £750.00

I was advised by the advisor that as proof of my maintenance funds of £800.00 I could use my business bank accounts if I prove that I was sole director and shareholder of my Ltd Co, which I subsequently provided.

My extension application has since been refused by the Home Office based on the fact that my business bank accounts are not acceptable evidence of the £800.00 maintenance funds. They stated that only personal bank accounts would be accepted.

Based on the above I have had to make an appeal. I have hired a solicitor who will represent me for the appeal.

My adviser who incorrectly stated that I could use my business bank account as evidence of the maintenace funds worked on a no application no fee basis. Therefore, I have rasied this with them and have requested that I be reimbursed the fee of £750.00 I am currently waiting a reply.

I am considering raising a complaint about my adviser to the OISC, however I am wanting to know if they deal with reimbursements. ie if I raise a complaint and they deem the advisor to be in the wrong will I be compensated my fee as well as my solicitors costs for the appeal.

If they do not deal with reimbursements what is the best way to try and recoup the fee (if not received back from my advisor) and the solicitors charges for the appeal? I am wanting to do this without, if at all possible, paying any further legal fees.

Any help which anyone can provide is greatly appreciated.
